One of the benefits of a prenuptial agreement (a prenup) is that it simplifies the divorce process and significantly reduces attorney fees. By pre-emptively addressing some of the highly contested issues such as property division and debt obligations, the agreement allows for quick resolution of divorce cases. The agreement also protects separate property and helps avoid potential conflict in a divorce proceeding on which property is communal and which is not. A prenup can also determine the financial future of the children, by protecting any property a parent intends them to inherit.
