Most California DUI cases do go to trial, and if yours does, you do have the right to a jury trial. While the decision to have either a judge or jury trial is entirely yours, you should consult your DUI defense attorney when making it. In cases with a jury trial, the court selects 12 jurors from the community to hear the case. For a conviction, the law requires the prosecutor to convince all the jurors, beyond a reasonable doubt, that you are guilty.
